1. Who we are
This site is operated by Zayvon Digital LTDA ("Zayvon Assessoria"), registered under Brazilian company ID (CNPJ) 37.142.898/0001-42, headquartered at Rua Príncipe Humberto, 112, Conj. 44, Centro, São Bernardo do Campo - SP, Brazil, 09725-200. By accessing and using the site, you agree to these Terms of use. If you do not agree, please do not use the site.
2. What the site offers
The site presents Zayvon's marketing and performance agency services and provides free tools, such as the Quick diagnosis and the ROI calculator, along with forms and shortcuts to get in touch on WhatsApp.
Hiring any Zayvon service does not happen through the site. It is formalized through a separate proposal and contract, which take precedence over these Terms wherever they conflict.
3. Free tools and simulations
The Quick diagnosis and the ROI calculator are guidance tools. Their results are estimates based on the information you provide and on simplified assumptions.
These results do not constitute a promise, a performance guarantee, or financial, accounting or legal advice. The real outcome of any marketing action depends on factors such as market, offer, competition, seasonality and sales operations.
4. Proper use
By using the site, you agree to:
- provide truthful information in the forms;
- not use the site for unlawful, fraudulent purposes or purposes that infringe on the rights of others;
- not attempt to access restricted areas, overload, mass-copy or interfere with the site's operation;
- not submit offensive content, spam or malicious code.
5. Intellectual property
Text, trademarks, logos, layout, illustrations and other content owned by the site belong to Zayvon or are used with authorization. They may not be reproduced, distributed or modified without prior written authorization.
Client and third-party platform trademarks and logos shown on the site belong to their respective owners and are displayed only to identify clients served and tools we work with, without implying an official partnership, unless expressly stated.
6. Links and third-party services
The site may contain links and integrations from third parties, such as WhatsApp and our CRM's form system. These services have their own terms and policies, and Zayvon is not responsible for their content or practices.
7. Limitation of liability
We work to keep the site available and its information accurate, but we do not guarantee it will be free of errors or interruptions. To the extent permitted by law, Zayvon is not liable for decisions made solely on the basis of the site's content or simulations, nor for damages arising from downtime, technical failures or third-party actions.
8. Privacy
The processing of personal data on the site follows our Privacy policy and our Cookie policy, which form part of these Terms.
9. Changes
We may update these Terms at any time. The version in effect is always the one published on this page, with the last-updated date shown at the top.
10. Governing law and jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil. The courts of São Bernardo do Campo, SP, Brazil are elected to resolve any disputes, except where the law guarantees the user the right to bring a claim in another jurisdiction.
